A Network Access Agreement is consent in writing that allows communications providers such as Gigaclear to carry out work on privately-owned land. When a landowner signs a NAA with Gigaclear, they are agreeing that we may install, maintain, and repair our communications equipment on their land.
We design our network using as much public land as possible, using verges, footpaths and roads. In some instances however the network design will need to cross privately owned land. Where this is the case, a Network Access Agreement is likely required. If you have received a Network Access Agreement, it is because we are requesting permission from you to install and maintain fibre optic equipment on land that you own.
We hope the benefits of our service to your community will mean we can come to an agreement that works for both parties. However, if we can't reach agreement with a landowner, under the Electronic Communications Code (the Code), we can ask the court to impose an agreement in the interests of delivering good communication infrastructure to everyone.
A Peppercorn is a token payment, paid as consideration to form a legally binding contract and create a legal relationship between parties. There is no requirement for a physical payment to change hands.

No, all of the equipment will remain the property of Gigaclear.
We often work with agricultural landowners and this means we are sensitive to their needs and priorities. We keep disruption to a minimum and ensure our equipment does not interfere with the normal use of the land.
If the cable or other equipment is damaged, this could mean the internet connection for an entire area will be lost. We expect landowners to take care not to damage any equipment in order to avoid risks such as lost connectivity and any further disruption.
Occasionally we may need to inspect and/or repair our network. The Network Access Agreement gives us permission to do this but we will always do our best to contact you and explain when we will be there.

A POT is the ‘point of termination’ of the network, usually located on the boundary of the property curtilage that the POT is intended to serve. It is a small black box which sits underground. Once installed it appears similar to a water main access point sitting flush with the ground, usually with a black plastic lid.
An Access only Agreement is a consent that Gigaclear require to access existing equipment on privately owned land. Gigaclear have a number of arrangements in place with other utility companies which allows the shared use of the existing infrastructure. The Access only Agreement enables Gigaclear to make use of these arrangements. The existing infrastructure for example, may be existing ducting underground or poles with overhead cables.
In order to reach the best design for your property. Gigaclears’ design team needs to conduct a non-intrusive survey. This typically takes between 1-3 hours depending on the size and complexity of the building / premises and involves the taking of measurements, and photographs for the production of a survey pack and corresponding design. Where possible we prefer for property owners or their appointed representative to also attend to facilitate access and to assist our designers in determining the best design for your property.
Once our equipment is installed the most common reason for future attendance to your property will be to install customer connections and to repair /inspect the apparatus as required. Typically we will provide 7 days prior notice to you of our intention to access the property, however the exact arrangement for access to your property will be contained within your Network Access Agreement.
Our network designs are produced with the aim of minimising visual impact to buildings, both externally and internally. We work collaboratively with property owners to make this happen and are happy to adjust designs where possible to best meet the aesthetic of your property. When designing for listed buildings we apply these same principles but also ensure to collaborate with the local authority to ensure any works are appropriately consented.
There is nothing inherently dangerous about our equipment, unlike with an electricity cable or a gas main. There is also nothing that could do damage, such as a leaking water pipe. It is also not electromagnetically active.
No, our construction partners do all the work to dig the trench and reinstate the ground as close as possible to its original condition.

Openreach are required by regulation to offer a duct and pole access product to Communication Providers (CPs). The product is used by CPs to deploy their own cables, apparatus and networks in Openreach ducts and poles and is known as Physical Infrastructure Access (PIA). Gigaclear have been accepted by Openreach as an established user.
